BIS removed License Exception TSU / EAR 740.13(e) for source code in the 20 September 2016 rule (81 FR 64656); notices that still cite it, or call 5D002 source EAR99, point at rules that no longer apply.

        No ECCN in the notice (5D002, 5E002, 5A002 or 5D992). Publicly available encryption source code is classified before it is published, not after.
  ERROR README.md:7  [removed_tsu_citation]
        This notice cites License Exception TSU / EAR 740.13(e) for encryption source code. BIS removed that paragraph in the 20 September 2016 encryption rule (81 FR 64656) and moved the notification to 742.15(b).
  ERROR README.md:7  [false_exemption_claim]
        The notice claims the code is outside export control (or EAR99) because it is open source. Under 742.15(b) publicly available 5D002 source leaves the EAR only once 742.15(b)(2) is met (an email for non-standard cryptography), and EAR99 is not a classification for 5D002 encryption source.
